The discussion that follows in this article is that the parties agree to guarantee the immediate condition and lend him the responsibility for the loss, defect or defect of the property; in fact, the parties waive the principle of non-guarantor. However, the effect obtained from this condition is compensation by trustee in various ways. If, at the same time, the contract is secured to the surety; if the property is lost, defective or defective, without violations, it should be noted that it is possible for the parties to conclude that, in the event of loss, or How much damage does trustee incur? Because the basis of the responsibility is the contract, and the terms of the contract are basically the same. This agreement is valid and binding in accordance with Article 10 of the Iranian Civil Code and Article 25 of the Commercial Agreements Act and the sale of Afghan property. However, in cases where there is no agreement, if it is wiped out, it is the duty of trustee to pay the property. If the item is wasted, the defect is defective, and, in the meantime, the conditional agreement is guaranteed; in this case, the price of the aforementioned property will be charged. Keywords: trustee, Guarantee, Compensation, contracts. بحث که در این مقاله دنبال می شود اینکه طرفین توافق می کنند که بر امین شرط ضمان کنند و او را مسئول تلف، نقص یا عیب وارده بر مال مورد امانت نمایند؛ در حقیقت طرفین از اصل عدم ضمان امین چشم پوشی می‏کنند. بااین وصف، اثر که از این شرط به دست می آید جبران خساره توسط امین به طرق مختلف است. هرگاه در ضمن عقد امانی بر امین شرط ضمان شده باشد؛ در صورتیکه مال مورد امانت بدون تعدی و تفریط تلف، ناقص یا معیوب گردد، باید به این نکته اشاره کرد؛ ممکن است که طرفین در ضمن عقد توافق نمایند که در صورت تلف، یا حادث نقص و عیب، امین به چه میزان خساره پرداخت کند. چرا که مبنای مسئولیت امین قراردادی است و اصولاً شرایط قرارداد بر آن حاکم است. این توافق بر طبق ماده ۱۰ قانون مدنی ایران و ماده ۲۵ قانون قراردادهای تجارتی و فروش اموال افغانستان معتبر و الزام آور می‏باشد. لکن در موارد که توافق نشده باشد، هرگاه مال مثلی تلف گردد، امین مکلف می شود که مثل مال را تأدیه کند. اگر مورد تلف، نقص و عیب مال قیمی باشد؛ و در ضمن عقد امانی شرط ضمان شده باشد در این صورت، قیمت مال مذکور بر امین بار می گردد. /downloadfilepdf/617965
